  • Criminal Fraud and Election Disinformation - Law and Politics - cover

    Criminal Fraud and Election...

Deliberate mischaracterization of political opponents and their policies has always been a part of politics; however, lying, dishonesty, and distortion of the facts remain morally wrong and have the potential to obstruct important political interests. For example, a false or misleading claim publicized about an election candidate may lead someone to lose an election that they might otherwise have won. So, does—and should—the law seek to provide protection from the risk of this happening?

In attempting to answer this question, Jeremy Horder draws a key distinction between what is called "political viewpoint" fraud and "electoral participation" fraud. In the interests of protecting freedom of speech, false or misleading claims (disinformation) involving political viewpoint content should be tolerated, not only by the criminal law but also by the internet platforms which host political content. By contrast, in the interests of preserving the integrity of democratic electoral processes, disinformation involving electoral participation information should be prohibited by the criminal law and censored by internet platforms. This book explains how the criminal law in various jurisdictions frequently prohibits false or misleading political claims falling into both categories of disinformation, instead of concentrating on electoral participation fraud.

As Union commander George McClellan moved the Army of the Potomac up the Peninsula in early 1862, the Union army still had a nearly 2-1 advantage in manpower, so Army of Northern Virginia commander Joseph E. Johnston continued to gradually pull his troops back to a line of defense nearer Richmond as McClellan advanced. In conjunction, the Union Navy began moving its operations further up the James River, until it could get within 7 miles of the Confederate capital before being opposed by a Southern fort. McClellan continued to attempt to turn Johnston’s flank, until the two armies were facing each other along the Chickahominy River. At this point, the Union army was close enough to Richmond that they could see the city’s church steeples, but they would come no closer. By the end of May, Stonewall Jackson had startlingly defeated three separate Northern armies in the Shenandoah Valley, inducing Lincoln to hold back the I Corps from McClellan. When McClellan was forced to extend his line north to link up with troops that he expected to be sent overland to him, Johnston learned that McClellan was moving along the Chickahominy River.
The fate of the Confederacy would hang in the balance that summer, and in addition to having a direct impact on the rest of the fighting in 1862, the Peninsula Campaign would remain in the minds of Union soldiers and leaders over the next few years. Lincoln’s frustrations with different generals in the Army of the Potomac led to his promotion of Ulysses S. Grant as chief of all armies ahead of the Overland Campaign of 1864. When the Army of the Potomac was thwarted at the Battle of the Wilderness in early May 1864, it found itself in a similar position as Hooker at Chancellorsville, McClellan on the Peninsula, and Burnside after Fredericksburg. Union soldiers got the familiar dreadful feeling that they would retreat back toward Washington, as they had too many times before. This time, however, Grant kept moving south.

Across the eastern Mediterranean there has been discovered a great number of objects whose appearance or materials are extraneous to local cultures, whether it was an Egyptian amulet in Greece, a Greek vase in Africa, or thousands of strange amulets in Gibraltar. The remains are evidence that a huge amount of goods was once moved from one land to another, systematically transported and traded across the Mediterranean by the ancient commercial network of the Phoenicians. Beginning in the 13th century BCE, and lasting for more than a millennium, this civilization dominated the most important body of water known to the ancients. With their formidable ships and skills in trading, they made a name for themselves by trading between Egypt, Greece, Rome, Carthage, Sardinia, Spain, and eventually all the way to the Atlantic Ocean, establishing themselves as the undisputed lords of the sea.
One of the most crucial cities in the system was hidden beneath the Greek, Roman, and Crusader ruins of Lebanon: the ancient city of Tyre. "Seated at entrance to the sea," according to the prophet Ezekiel, Tyre was constructed on a purportedly impenetrable island. Tyre was considered to be one of the oldest and wealthiest metropolises of the world, and indeed, the city can be directly associated with some of the most important stages in the history of mankind.
Although Carthage by far preferred to exert economic pressure and influence before resorting to direct military power (and even went so far as to rely primarily on mercenary armies paid with its vast wealth for much of its history, it nonetheless produced a number of outstanding generals, from the likes of Hanno Magnus to, of course, the great bogeyman of Roman nightmares himself: Hannibal. Carthage was able to go from a minor Phoenician settlement to one of the most powerful trading empires of antiquity.

In the wake of the Civil War, African Americans attained freedom from chattel slavery, but continued to suffer discrimination both legal in the form of Jim Crow laws and de facto in the continued perception among the vast majority of white Americans that African Americans were at the very least inferior and at the most a constant dangerous presence in their communities who must be carefully controlled.
Durham, North Carolina’s "Black Wall Street" exemplifies the flourishing of Black enterprise under the constraints of Jim Crow segregation. Parrish Street became a central hub for African American businesses and financial institutions in the early 20th century. The district achieved national recognition from leaders such as Booker T. Washington and W.E.B. Du Bois, who regarded it as a model of Black achievement. Washington noted Durham’s relatively progressive racial climate, while Du Bois emphasized the city’s organized Black community and the extensive network of Black-owned businesses that enabled residents to fulfil nearly all their needs within their own community.
The origins of Black Wall Street can be traced to Durham’s transformation into an industrial center after the Civil War. Once a modest railroad stop, Durham rapidly became known as the tobacco capital of the world, primarily due to the Duke family’s business activities. The growth of the tobacco and textile industries attracted both Black and white workers, coinciding with a period of significant racial and economic challenges for African Americans. Despite segregation and disenfranchisement, Durham’s expanding economy created rare opportunities for Black entrepreneurship and enabled a degree of coexistence between influential white industrialists and an emerging Black middle class.
