Este texto se inspira en las Bases y puntos de partida para la organización política de la República Argentina publicada un año antes por Juan Bautista Alberdi. Su objetivo era constituir la unión nacional, afianzar la justicia, consolidar la paz interior, proveer a la defensa común, promover el bienestar general y asegurar los beneficios de la libertad para todos los hombres. La Constitución consta de dos partes: la primera se refiere a las declaraciones, derechos y garantías, mientras que la segunda se ocupa de las autoridades de la Confederación, incluyendo el Gobierno Federal y el Poder Legislativo. El Congreso tiene la atribución de formar y sancionar las leyes.
